What Does “Color of Title” Mean?

What Does Color of Law Mean?

To start, let's quickly define what "color of law" means. It represents a situation where something appears to have legal backing but lacks the substance of a genuine legal right.

Since 1913, when the banks took over, our country has been predominantly operating under "Color of Law" in virtually every sector of the government. People acting under color of law include police officers, prison guards, other law enforcement officials, judges, public health care providers, and other government-employed individuals or public officials.

What "Color of Title" Legally Means?

Now, let's revisit the concept of "color of title." The Supreme Court of Missouri has defined it as follows: "When we say a person has a color of title, whatever the meaning of the phrase may be, we are expressing the idea that an act has been previously done...by which some title, good or bad, to a defined parcel of land has been conveyed to him/her" (St. Louis v Gorman, 29 Mo. 593, 1860).

In simple terms, "color of title" refers to an apparent title that does not actually transfer true ownership. Various types of deeds such as warranty deeds, quit-claim deeds, sheriff's deeds, trustee's deeds, judicial deeds, tax deeds, and wills all fall under this category of conveying only color of title.
